§ 50.097 WASTEWATER CONTAINING METALS OR SIMILAR SUBSTANCES.
   (A)   No person shall discharge wastewater containing metals or substances in concentrations greater than those listed in the table below, wherein concentrations are those of composite samples collected over the daily period of operations in proportion to flow so as to produce a representative sample. However, if Q, the daily discharge of a user in gallons per day, is less than 25,000, then the allowable concentration shall be calculated by multiplying the tabulated value by 25,000, but in no event shall an allowable concentration of metals exceed five times the respective tabulated value.

   (B)   These effluent limitations have been established to assure compliance with NPDES permits and to protect personnel and treatment plant processes, and may require adjustment if such compliance or protection is not achieved. Any adjustment will be made only after notice and a public hearing, as required by law.
   (C)   Notwithstanding any other provisions of this section, the Water and Sewer Commission and the Sanitation District No. 1 of Campbell and Kenton Counties shall require pretreatment according to the applicable EPA pretreatment standards whenever so ordered by governmental authorities, either by the terms of the NPDES permit or by a condition of a financial grant, or for other reasons arising from the Water and Sewer Commission's or the Sanitation District No. 1's legal obligations and duties.
