§ 150.07 SETBACK REQUIREMENTS.
   (A)   It shall be unlawful for any person, firm, or corporation to locate, erect, or construct any residential or commercial structure or building within the city limits, except as hereinafter provided.
   (B)   No dwelling, mobile home, or other structure shall be erected or placed on a lot which does not abut at least one public street for a minimum distance of at least 50 feet.
   (C)   No dwelling or mobile home or any other structure other than fences shall be erected or placed on a lot unless such structure is located not less than five feet from the property line in all directions.
   (D)   The five-foot setback may be waived by the adjoining property owners only if such adjoining property owners shall execute a document which shall constitute a covenant running with their land which prevents the adjoining property owner or his successors or assigns from constructing or causing to be placed any structure closer than ten feet of the structure for which waiver is granted. The securing of the waiver shall be the responsibility of the property owner desiring the waiver, and the document shall be recorded in the office of the Fleming County Clerk at the expense of the property owner requesting the waiver. The waiver shall be on a form provided by the city, and it shall be the responsibility of the property owner requesting the waiver to see that all proper parties shall execute the waiver document.
