§ 73.02 CITATION FOR VIOLATION; CONFISCATION; PENALTY.
   (A)   Any police officer who issues a citation for violation of this subchapter shall confiscate the bicycles, motorcycles, mopeds, hover boards, skateboards, coasters, roller blades or roller skates used in the violation and place it in a secure area.
   (B)   The bicycles, motorcycles, mopeds, hover boards, skateboards, coasters, roller blades and roller skates may be returned to the violator or to a parent or guardian of the violator, if the violator is a minor, after the following periods of time; 1) after ten (10) days for a first violation, after twenty (20) days for a second or subsequent offence; and after thirty days (30) for a third or more offense.
   (C)   Violation of this subchapter is punishable as a Class B. Misdemeanor as defined by KRS 532.020(3), and includes a fine up to fifty dollars ($50.00) for the first offense, a fine up to one hundred dollars ($100.00) for the second offense, and up to ninety (90) days detention/incarceration and a fine up to two hundred and fifty dollars ($250.00) for the third or greater offense. Nothing in this subchapter shall prevent any police officer from issuing a first or second warning as opposed to issuing a citation.
   (D)   If the violator of this subchapter fails to retrieve property confiscated relating to a violation of this subchapter, the method of disposal after the specific period of time shall be as prescribed by Kentucky law for forfeited property.
