It is a defense to a violation under § 130.16 that the child was absent from school because of:
(A) Illness;
(B) Observation of a religious holiday;
(C) Death in the immediate family;
(D) Family emergency; and
(E) Such other situations beyond the control of the student, as determined by the Board of Education in each district, or such other circumstances which cause reasonable concern to the parent for the safety or health of the student.
