303.13 OPERATION ON IMPROVED ROADWAYS ONLY.

(a) No motor vehicle shall be operated anywhere between the boundary lines of any highway or public way open for travel except on that portion of the surface which is improved for vehicular travel by paving or other treatment, but not including the berm or shoulder adjacent to such improved portion.

(1979 Code 70.10)

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
