303.12 OPERATION ON PRIVATE PROPERTY.

(a) No motor vehicle shall be operated over and on any private property without the owner or occupier of the property giving permission for such operation. This section shall not apply to the use of private driveways in connection with ordinary commerce or to licensed vehicles engaged in the necessary "turning around" operation.

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
