123.01 AUTHORITY IN AN EMERGENCY CRISIS.
   (a)   The Mayor is granted the power to invoke by proclamation a state of emergency in the City during an emergency crisis, as proclaimed by the Governor.
 
   (b)   The power conferred to the Mayor shall include, but not be limited to, the power and authority to order all nonessential services, which shall include, but not be limited to, all business establishments, commercial establishments, industrial centers, factories, entertainment centers, recreational facilities, schools and churches to close, but shall permit the Mayor to allow retail food establishments to remain open on a limited basis, as well as drug stores and medical facilities, including the hospital.
 
   (c)   In the event the Mayor deems it necessary to issue a proclamation of a state of emergency, he shall do so by issuing a detailed proclamation to the news media, including newspaper, radio and television, and, when practical shall notify all businesses and establishments affected.
 
   (d)   Whoever violates any provision of the proclamation issued by the Mayor under the authority of this section shall be guilty of a misdemeanor of the third degree and each days violation shall constitute a separate offense.
