953.06 RECEPTACLES.
(a) Each and every owner, tenant, housekeeper or other person occupying any dwelling house or apartment house and other buildings or a portion thereof in the City, and producing waste for collection shall provide and renew when necessary a sufficient number of garbage cans to hold the waste accumulating thereon. All cans shall be provided with tight-fitting covers and strong handles on the outside, and shall be watertight. Each can shall have a capacity of not less than ten gallons. All cans shall be maintained by the user in good and sanitary condition. In addition thereto or in lieu thereof there may be furnished a sufficient number of plastic garbage bags for the purpose of disposing of waste on such premises. If plastic garbage bags are used, they shall be stored inside the premises and placed outside only when they are scheduled to be picked up by the waste hauler. For this purpose, it shall be permissible to place plastic garbage bags properly secured and tied the evening before the scheduled pickup by the waste hauler.
(b) Any waste for collection under the provisions of this chapter shall be placed in a practical receptacle that can be readily handled for emptying, located near the can.
(c) If any plastic bags are torn open by animals or high winds, or any other cause and the contents are blown and scattered about the neighborhood, it shall be the responsibility of the property owner to clean up the trash that has been scattered about.
(d) The property owner of apartment houses, rental houses or any other buildings which contain tenants may delegate the responsibility of waste removal to his tenants, but in the event his tenants fail to have the waste removed as specified in this section, the property owner shall be primarily liable for causing the removal of waste from the premises, thus abating any possible nuisances.
(e) All dumpsters used for the storage of waste shall be of leakproof construction with tight-fitting lids which are to be kept closed. It is the licensed hauler's responsibility to ensure that lids are closed after completion of emptying the dumpsters. It is the proprietor's responsibility to ensure that lids are closed at all other times.
(f) Dumpsters shall be emptied and cleaned by the hauler as often as necessary to maintain them in a clean condition and to prevent undue odors.
(g) Before leaving the premises after emptying a dumpster, the licensed hauler is to clean up any waste on the premises spilled during the emptying of the dumpster.
(h) All dumpsters shall be labeled by hauler name and phone number.
