925.16 SCHEDULE OF CHARGES.
   There is levied and assess upon each lot, parcel of land, building or premises having any sewer connection with the public sewer system of the City or otherwise discharging wastewater, industrial wastes, water or other liquid, either directly or indirectly, into the public sewer system, a sewer service charge payable as hereinafter provided and in the amount determinable as follows:
   (a)   For any lot, parcel of land, building or premises situated within the service area of the City sewer system and having a connection with the public sewer system or otherwise discharging wastewater, water or other liquids, either directly or indirectly into the public sewer system, the charges shall be based upon the quantity of water as measured by water consumption meters.
   (b)   Any significant industrial user situated within the service of the City sewer system and having a connection with that system or otherwise discharging industrial waste, either directly or indirectly, into that system, shall be charged in accordance with the following:

      (1)   Quantity of Wastewater Discharged (Q). The volume used for computing industrial waste charges shall be the metered water consumption of the user as shown in the records of water meter readings maintained by the City except as provided herein in this section. If the user discharging industrial wastes into the public sewers procures any part, or all of this water from the user shall install and maintain at his expense water meters of a type approved by the City Engineer for the purpose of determining the volume of water obtained from those other sources. The user discharging industrial wastes into the public sewers may install and maintain at his expense a metering instrument for determining the volume of waste being discharged to the public sewer. The instruments shall be of a type acceptable to the City Engineer. The City Engineer may require the installation of an instrument for measuring the volume of waste discharged if the volume cannot otherwise be determined from the metered water consumption records. Any instrument for determining the volume of waste discharged to the public sewer shall be installed, owned, maintained and calibrated annually at the expense of the user. Certification that the calibration has been performed shall be provided to the City Engineer within thirty (30) days of the calibration.
      (2)   A significant industrial user is defined by the City in accordance with 40 CFR 403.0, subsection t, as:
         A.   All users subject to categorical pretreatment standards; or
         B.   Any user that discharges an average of 25,000 or more gallons per day to the sewer system; or
         C.   Any user that contributes five percent (5%) or more of the average dry weather hydraulic or organic capacity of the wastewater treatment plant; or
         D.   Any user that, in the opinion of the Service Director, has a reasonable potential to adversely affect the performance of the wastewater treatment plant or for violating any pretreatment standards.
      (3)   The charge for the quantity of waste discharged, and for industrial waste discharges where concentrations of the following parameters exceed the limits set forth in Sections 925.06 (d) or 925.07 (e), shall be as follows:

   In addition to the above, the monthly minimum based on meter size will be charged.
   (c)   Any residential customer of the wastewater system that does not also have City water service shall be billed for their wastewater discharge on the basis of a usage of 6,000 gallons per month (800 cubic feet). The usage for any nonresidential customer in this situation shall be established by the City Engineer.
   (d)   On an annual basis, at a time to be determined by the POTW authority, the costs associated with all facets of the POTW operation, including but not limited to: OM & R, debt service and administration and billing, shall be audited. At that time, any necessary changes in the user charges will be made to reflect each user's fair and equitable share of total costs.
   (e)   On an annual basis, and at a time of a regular billing, each user shall be notified of the rate and that portion of the user's sewer service charge which is attributable to OM & R costs to wastewater treatment services.
   (f)   All users connected to the POTW shall compensate the POTW for their fair and equitable share of total treatment costs. No free service shall be made to any user.
   (g)   The sewerage service charge or rental provided in this chapter shall be payable monthly at the water and sewer office of the City, and at the option of such office, may be payable at the same time as water bills are payable.
   (h)   A customer or specific group of customers of the wastewater system who for their own benefit cause a capital improvement to be made to the wastewater system, such customer or customers may be required to pay for the partial or total cost of such improvement. The actual cost of the improvement shall be determined by the City Engineer and the terms and amount of the payment shall be determined by City.
