925.05 PRIVATE SEWAGE DISPOSAL SYSTEMS.
   (a)   Where a public sanitary or combined sewer is not available under provisions heretofore provided, the building sewer shall be connected to a private wastewater disposal system complying with all requirements of this chapter and with requirements of the OEPA, the City Engineer and the City Board of Health.
   (b)   Before commencement of construction of a private wastewater disposal system the owner shall first obtain a written permit signed by the City Health Commissioner. The application for such permit shall be on forms furnished by the City and shall be supplemented by any plans, specifications and other information as are deemed necessary by the City. A permit and inspection fee of twenty-five dollars ($25.00) shall be paid to the City at the time the application is filed.
   (c)   A permit for a private wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the City Board of Health. They shall be allowed to inspect the work at any stage of construction and, in any event, the applicant for the permit shall notify the City Board of Health when the work is ready for the final inspection, and before any underground portions are covered. The inspection shall be made within forty-eight hours of the receipt of notice by the City Board of Health, excluding Saturdays, Sundays and holidays.
   (d)   The type, capacities, location and layout of a private wastewater disposal system shall comply with all recommendations of the OEPA and Board of Health of the City. No permit shall be issued for any private wastewater disposal system employing subsurface soil absorption facilities where the area of the lot available for such purpose is less than 15,000 square feet. No septic tank or cesspool shall be permitted to discharge to any public storm sewer or natural outlet.
   (e)   At such time as a sanitary sewer becomes available to a property served by a private wastewater disposal system, a direct connection shall be made to the sanitary sewer within one year of the time the sewer becomes available for use and any septic tanks, cesspools, and similar private wastewater disposal facilities shall be removed or abandoned. Abandoned facilities shall be filled with gravel or other suitable material as per City and OEPA requirements.
   (f)   The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times at no expense to the City, and in such a manner as not to create a public nuisance.
   (g)   No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the health officer.
