909.03 BANNERS.
The Service-Safety Director is authorized to grant permission to religious, charitable and nonprofit organizations to hang banners across Main Street within the City subject to the following terms, conditions and requirements:
(a) The placement of banners shall be at a location approved by the Department of Engineering.
(b) Prior permission shall be secured from the public utility owning the poles to which the banner is to be attached.
(c) The lowest point on the banner shall be at least nineteen feet above the roadway, and it shall be installed in a manner which will not obstruct the vision of motorists or pedestrians.
(d) The banner as hung shall be constructed to offer minimum wind resistance and the attachment guys or cordage shall be of sufficient strength to provide a maximum safety factor.
(e) Before permission is granted to hang a banner, the religious, charitable or nonprofit organization shall secure general liability insurance insuring the City and the religious, charitable or nonprofit organization from any liability for bodily injury with limits of fifty thousand dollars ($50,000) for each person and one hundred thousand dollars ($100,000) for each occurrence, and property damage limits of twenty-five thousand dollars ($25,000) per accident.
