907.09 SIDEWALK CONSTRUCTION BOND.
   Any person, firm or corporation including the owner of the abutting property, constructing or desiring to construct a new sidewalk within the City shall, before entering on any work, file with the Service-Safety Director a performance bond or cash bond to the City of twenty-five dollars ($25.00) per lineal foot of sidewalk to be constructed. The bond and surety shall be subject to the approval of the Service-Safety Director as to sufficiency and of the Director of Law, as to form, and conditioned that the sidewalk shall be constructed or caused to be constructed by the person, firm, owner, or corporation during the time for which the bond shall be written, shall be done and completed in accordance with the respective contracts therefor, and in accordance with the plans and specifications, rules and regulations, and the ordinances of the City in every particular. The performance bond or cash deposit shall be for the purpose of guaranteeing to the City that sidewalks will be installed at the site improvement, and the sidewalks shall be installed not later than one year from the date of the original performance bond or cash deposit. Should the person, firm, owner or corporation fail to construct the sidewalk within the one year provided for herein, then, and in such event, the City shall assume the responsibility for the sidewalk installation and execute on the performance bond or cash deposit for the cost of the installation.
   Any person, firm or corporation other than the owner of the abutting property, repairing or replacing a sidewalk within the City shall, before entering on any work, file with the Service- Safety Director a performance bond or cash bond to the City of twenty-five dollars ($25.00) per lineal foot. The bond and surety shall be subject to the approval of the Service-Safety Director as to sufficiency and of the Director of Law, as to form, and conditioned that all walks, or parts of walks, which shall be repaired or replaced or caused to be repaired or replaced by the person, firm or corporation during the time for which the bond shall be written, shall be done and completed in accordance with the respective contracts therefor, and in accordance with the plans and specifications, rules and regulations, and the ordinances of the City in every particular. The performance bond or cash deposit shall be for the purpose of guaranteeing to the City that sidewalks will be installed at the site improvement, and the sidewalks shall be repaired or replaced not later than ninety (90) days from the date of the original performance bond or cash deposit. Should the person, firm or corporation fail to repair or replace the sidewalk within the (90) days provided for herein, then, and in such event, the City shall assume the responsibility for the sidewalk installation and execute on the performance bond or cash deposit for the cost of the installation.
