767.01 SALE OF GOODS ON STREET; LICENSE.

   (a)   No person shall sell any goods, merchandise or medicines on Main Street in the City, between Lima and Center Streets, or on any streets or alleys connecting with Main Street between Lima and Center Streets, within 400 feet of Main Street. Goods, merchandise and medicines may be sold at other places in the City when the seller has obtained a license to do so issued by the Mayor.

   (b)   Subsection (a) hereof shall not apply to local merchants and businesses that have a fixed place of business located within the defined area as described herein and they shall be permitted to transact business within such area on the streets or alleys provided, however, that the conduct of business is on a temporary basis with no fixed or permanent structures or fixtures and that at the close of business each day the street or alley is restored to its original condition.
