4-6-4: INSPECTION OF PREMISES; ACTION BY INSPECTOR:
The inspector is hereby authorized and directed to inspect and examine real property situated within the City for the purpose of determining whether or not it contains injurious or noxious weeds, garbage, refuse, public nuisances and/or unsightly or deleterious objects or structures, and for the purpose of determining whether or not the existence of said weeds or objects creates a fire hazard or constitutes a source of contamination or other danger to health and safety, or otherwise creates public nuisances, as above declared. The inspector in conjunction with or in addition to the duties in this Article shall meet the requirements of Utah Code Ann. §§ 10-11-2 and 3. If the inspector concludes that such conditions exist in whole or part, the inspector shall:
   A.   Ascertain Information:
      1.   Ascertain the names of the owners and/or occupants. The property owner is the primary partly responsible for the maintenance of such land. The non-owner occupant of property is secondarily responsible in the event the property owner cannot be located after a reasonable search, or is unavailable due to death, disappearance or similar circumstances. As such, the non-owner occupant of properly will receive notice pursuant to subsection B. of this section in the event the property owner cannot be located or is otherwise unavailable.
      2.   Document and describe the premises where such objects and conditions exist.
   B.   Service Of Notice: Serve notice in writing upon the owner and occupant of such land, either personally or by mailing notice, postage prepaid, addressed to the owner and/or occupant at their respective last known mailing addresses, as disclosed by the records of the County Recorder, or as otherwise ascertained, requiring such owner or occupant, or both as the case may be, to eradicate or destroy and remove the same within such time as the inspector may designate, which shall not be less than two weeks from the date of service of such notice.
