If situations arise that make it difficult or inequitable to apply the cost recovery formula set forth above, the City Council will determine the amount allowed, on a case by case basis, to the person or entity entitled to cost recovery. Such a determination shall be made only after such person or entity appeals to the City Council for consideration of such cost recovery. The City Council's decision shall be final.
