7-5-1: POLICY FOR RECOVERY:
   A.   Specified: Any person who builds a road in the City shall pay all the costs associated with the construction of the road. A developer who extends a road beyond what a developer has already constructed, should pay a recovery fee of the costs the said developer paid in costs for the road they constructed. When a person recovers said costs from the next subsequent developer who extends the road, said person shall be deemed compensated in full and no longer eligible to recover additional costs. Recovery cost reimbursement shall cease once recovery costs reach a minimum of one hundred dollars ($100.00).
   B.   Illustration: By way of illustration:
      1.   Developer A builds a road extension and pays ten thousand dollars ($10,000.00) for the cost of constructing the road. Developer B extends the road four hundred feet (400') from the original point of extension, attributing forty percent (40%) of the road to developer B (1,000 times 40 percent equals 400 feet). Developer A is entitled to fifty percent (50%) of the cost value from developer B's extension ($10,000.00 times 40 percent equals $4,000.00). Developer A may continue to recoup from subsequent developers up to fifty percent (50%) of the costs expended to extend the road. Developer A shall then be considered fully compensated and become ineligible to recover any additional costs.
      2.   Developer C extends a section of road from the original road. Developer B shall be entitled to recovery from developer C and/or subsequent developers two thousand five hundred dollars ($2,500.00), which is fifty percent (50%) of the cost developer B paid to developer A ($5,000.00). Developer B shall then be considered fully compensated and become ineligible to recover any additional costs.
      3.   Developer B extends the road further, beyond developer A's original road constructed. Developer A shall be entitled to recover fifty percent (50%) of his/her total extension costs ($5,000.00) from developer B. Developer B shall be entitled to recover fifty percent (50%) from developer C and/or subsequent customers ($2,500.00) of the costs developer B paid to developer A and in addition thereto, developer B shall be entitled to recover fifty percent (50%) of the costs from developers who connect to developer B's additional road extension. Developer B shall then be considered fully compensated and become ineligible to recover any additional costs.
      4.   This pattern continues until the cost recovery any additional costs. (Ord. 18-02, 5-15-2018)
