7-1-3: CONSTRUCTION OR REPAIR OF PUBLIC WAYS:
   A.   Permit Required: It shall be unlawful to construct or lay any pavement on any public street, sidewalk or other public way, or to repair or alter the same, without first having secured a permit therefor. Application for such permit shall be made to the City Recorder, and shall state the location of the intended pavement or repair, the extent thereof, and the person or firm who is to do the actual construction work. No permits shall be issued except where the work will conform to the ordinances of the City.
   B.   Public Safety:
      1.   Any person, firm or corporation laying or repairing any pavement on a street, sidewalk or other public place, or making excavation of the same, shall maintain suitable barricades to prevent the injury of any person or vehicle by reason of the work. Such barricades shall be protected by a light at nighttime. Any defect in the recessed pavement shall be barricaded to prevent injury. Any person, firm or corporation properly maintaining any open excavation while the same remains open shall guard the same with proper barricades and lights.
      2.   It shall be unlawful to disturb any barricade of lights lawfully placed to protect or mark any new pavement or new excavation or opening on any public street, sidewalk or other public way.
      3.   It shall be unlawful for any person knowingly and intentionally and without legal cause to remove flashing lights or lanterns from the construction area.
   C.   Conformance With Specifications: All street and sidewalk pavement shall be made in conformity with specifications laid down or approved by the City Council.
   D.   Injury Prohibited: It shall be unlawful to walk upon or drive any vehicle around and upon, or injure any newly laid street or sidewalk while the same is guarded by warning sign or barricade, or to knowingly injure any soft or newly laid pavement. (1995 Code § 5-1-102)
