7-1-5: ENCROACHMENTS OVER PUBLIC SIDEWALKS:
   A.   Definitions:
    AWNING: A shade structure for which the primary purpose is shelter from the elements, signage, or an architectural feature that is constructed of canvas, metal or nylon materials. Excluded materials include, but are not limited to, plastic and vinyl. Awnings shall not extend more than five feet (5') from the front of the building over public property.
   ENCROACHMENT: Any structure in the General Commercial District considered to be permanent in nature, including, but not limited to, wheelchair accessible ramps, attached signs and flower boxes, and shall not extend more than four feet (4') from the front of the building over public property.
   STOREFRONT EXPANSION AREA: An area that shall not extend more than four feet (4') from the front of the building over public property in the General Commercial District, which may be used by a business to add visual design elements to increase the charm, character and attractiveness of the storefront and improve economic viability.
   B.   Authorization Required: It shall be unlawful to place or cause to be placed any encroachment, as defined in subsection A of this section, on or above public sidewalks without authorization from the City and in accordance with this section.
   C.   Permitting Process: Encroachments may be granted, or denied by the City Council upon completion of the permitting process as required by the City Encroachment Policy.
   D.   Requirements:
      1.   Encroachments that extend into the airspace over public property must be placed at least seven feet (7') above the public sidewalk.
      2.   Permanent encroachments shall be designed in a manner that enhances the aesthetic atmosphere of the General Commercial District. Construction specifications and suggested design criteria shall be included in the City Encroachment Policy.
      3.   Permanent encroachments may be located on or above public property and sidewalks or in storefront expansion areas if attached securely and do not obstruct the travel area for pedestrians or pose a threat to their health, safety and welfare.
   E.   Exclusions: Sandstone benches, trash receptacles and light pole banners placed by the City are excluded from the provisions of this section. (Ord. 11-04, 5-17-2011; amd. 2019 Code)
