A. Prohibition: The City Council hereby declares that it finds that the disposal of solid waste material is a legitimate function of the City's governmental functions. It further finds that for the health and safety of its residents, solid waste disposal be reserved as a public function. Therefore, it shall be unlawful for any person, firm or corporation to operate or establish any private landfill or other garbage or rubbish dump.
B. Exception: Nothing in this section shall limit any private person, firm or corporation from operating or establishing a private garbage or rubbish collection service:
1. So long as all garbage or other rubbish collected within the City limits is disposed of in landfills or other dumps belonging to the City or the County pursuant to the Interlocal Agreement entered into between the City and the County; and
2. The rubbish collection services comply with all applicable City ordinances. (1995 Code § 19-1-102)
