The License Administrator shall have the power to:
A. Adopt Forms: Adopt all forms and prescribe the information as approved by the City Council that is required therein as to all matters relevant for the issuance of a license hereunder.
B. Investigate: Investigate and determine the eligibility of any applicant or licensee either at the time of issuance of a license or at any reasonable time after its issuance in such a manner as may be reasonable and necessary for the proper administration and enforcement of this title. In the case of persons licensed by an agency of the State, verification of such licensure shall suffice without further inquiry into the qualifications therefor. The Emery County Sheriff, Fire Chief, Health Department, City Attorney and their authorized officers and deputies are authorized and declared to be investigators for the License Administrator upon request of the latter. C. Inspection Of Premises: Shall assign inspections and may accompany during prospective or existing places of business to ensure compliance with Building, Safety and Health Codes that are reasonably necessary to the administration and enforcement of this title; provided that all such inspections shall be at a reasonable time, upon proper advance notice to the applicant or licensee, and in full compliance with the laws affecting the right to inspect.
D. Give Notice: Notify the applicant of the acceptance or denial of the application, declare home businesses a no-impact home business and, in the event of denial, upon the request of the applicant, state in writing the reason for denial. (Ord. 2018-1, 2-8-2018)
E. Request Enforcement: Request the City Council and City Attorney to seek revocation of a license and/or to file a complaint against any applicant or licensee who conducts a business without the license required by this chapter.
F. Good Standing: Where permitted by law, require that the applicant or licensee be not in default under the provisions of the City ordinance, nor indebted nor obligated in any manner to the City utilities operated by it, nor to be in violation of any City zoning regulations.
G. Require Affidavits: Require, when legally appropriate and considered necessary in the discretion of the License Administrator, affidavits regarding the license history of the applicant indicating whether such person, in previous business operations in this or another state, has had a business license revoked or suspended, together with the reasons therefor; to request the Sheriff to obtain a record of any prior convictions of the applicant or licensee when determined by the License Administrator to be necessary and desirable.
