8-2-2: ADMINISTRATION AND ENFORCEMENT:
   A.   Watering Schedule And Uses:
      1.   Water shall be available for use in the secondary irrigation system during the irrigation season; provided, that the users adhere to the following stipulations: (Ord. 2003-2, 5-8-2003)
         a.   Watering Hours And Days: No watering is allowed during the hours of ten o'clock (10:00) A.M. to six o'clock (6:00) P.M. or as determined by the city council each year based on the water storage levels. Watering days may also be set by a schedule to restrict water usage during drought years as determined by the city council. (Ord. 2006-2, 5-11-2006)
         b.   Watering Days: (Rep. by Ord. 2006-2, 5-11-2006)
Note: In the event Millsite Reservoir should reach full capacity allowing water to flow over the spillway, all restrictions shall be lifted until at such time water ceases to flow from the spillway. Immediately upon the water ceasing to flow over the spillway, all restrictions are again in force. At that time Ferron City will post notifications at the regular designated posting locations. It will be the responsibility of the water users to be aware of these changes. No further notice will be sent. In the event a definite shortage should occur, Ferron City officials shall call an emergency water meeting to put into effect an emergency water ordinance. (Ord. 2006-2, 5-11-2006)
         c.   Open Hose Watering: No open hose watering or flood irrigating of any kind. It is required that some type of restriction device be attached at the hose opening for watering purposes.
         d.   Waste Of Water: Each property owner shall be responsible for water runoff from his property. It shall constitute a violation of this chapter to allow water to run onto land owned by another or by the city. (Ord. 2003-2, 5-8-2003)
      2.   The following items are exceptions to the above rules:
         a.   Necessary watering of outside potted plants.
         b.   Watering of new lawns.
         c.   Watering of trees and shrubs with an installed drip system.
         d.   Washing of vehicles allowed only with the use of a twist nozzle at the hose opening so that no water waste occurs. (Ord. 2011-2, 4-28-2011)
      3.   Any violation of this subsection A will constitute the following penalties:
First offense: Written warning.
Second offense: Fifty dollar ($50.00) fine that must be paid by four thirty o'clock (4:30) P.M. on the next business day to prevent loss of services. Fee must be paid prior to services being restored.
Third and subsequent offenses: Loss of secondary water services for fourteen (14) days and a one hundred dollar ($100.00) fine. Fee must be paid before services will be restored. No credits or adjustments will be made to utility bills for loss of service. (Ord. 2003-2, 5-8-2003)
   B.   Distinctive Coloring: All exposed portions of the secondary irrigation system shall bear distinctive "red" coloring as prescribed by state statute.
   C.   Inspection Of System: The authorized representatives of the city may during reasonable hours and with notice to property owners inspect any portion of the secondary irrigation system on private property.
   D.   Service For Premises Only: It shall be unlawful to provide water from the secondary irrigation system to property owned by another.
   E.   Sale Of Water Prohibited: It shall be unlawful for the owner of a connection to sell or otherwise distribute water from that connection for use other than on the premises. It shall likewise be unlawful to purchase or otherwise receive water from a secondary irrigation system connection owned by another. (Ord. 4-26-83, 4-26-1983, eff. 4-26-1983)
   F.   Cross Connections: Cross connections between the pressurized secondary water system and the pressurized irrigation system are prohibited. Any physical connections or arrangement of piping or fixtures which create a cross connection are illegal. This would include any temporary connections, such as swing connections, removable sections, four-way plug valves, spools, dummy sections of pipe, swivel or change over devices or sliding multipart tubes or other plumbing arrangements. It shall be the responsibility of the customer or consumer to comply with this subsection. If violations of this subsection exist or if there has not been any corrective action taken by the consumer within twenty four (24) hours of the verbal or written notification, then immediate loss of water services to the premises will take place until the customer has corrected the problem and received proper verification through appropriate inspections.    G.   Board Of Equalization: The city council is hereby established as a board of equalization with power to exempt, abate or defer fees due under this chapter upon a showing of adequate cause. (Ord. 4-26-83, 4-26-1983, eff. 4-26-1983)
