§ 155.04 OIL OR GAS WELL DRILLING AND PRODUCTION "BY RIGHT".
   (A)   The drilling and production of oil or gas within the corporate limits of the city shall be permitted by right within AG Agricultural Zoning Districts provided that no residential structure or place of assembly, institution or school exists no closer than 600 feet from the wellhead or within a previously platted residential subdivision where 1 or more lots have structures and provided that the drilling and production of gas meets the following requirements:
      (1)   All applicable standards and requirements have been met as set forth in this chapter, standard conditions for oil or gas well drilling and production;
      (2)   An approved oil or gas well development plat and a road repair agreement are on file with the city; and
      (3)   An oil or gas well permit has been issued by the city.
   (B)   The drilling and production of gas within the corporate limits of the city shall be permitted by right within AG Agricultural Zoning District if the property owner of a residential structure within 250 feet to 600 feet of the wellhead agrees in writing and provided that the drilling and production of gas meets the requirements of this chapter.
