The Animal Control Officer, or his or her designated deputies or any peace officer is authorized to:
(A) Kill an animal which poses an imminent danger to a person or property or when a real or apparent necessity exists for destruction of the animal; and
(B) Impound an animal, which is diseased or endangers the health of a person or another animal or is in violation of the provisions of this chapter.
