(A) Title. This subchapter shall be known as the Garbage Collection Ordinance of the city.
(B) Definitions. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
PREMISES. Include:
(a) LIGHT COMMERCIAL UNITS. Retail or light commercial types of businesses that do not generate more than 750 pounds per pickup; and
(b) RESIDENTIAL UNITS. Dwellings within the corporate limits of the city occupied by a person or a group of persons comprising not more than 2 families. A RESIDENTIAL UNIT shall be deemed occupied when either water or domestic electric utility service are being supplied thereto. A duplex dwelling, condominium dwelling, or apartment dwelling, whether of single or multiple level construction, consisting of 4 or fewer contiguous or separate single-family dwelling units, shall be treated as a RESIDENTIAL UNIT, except that each single-family dwelling within that RESIDENTIAL UNIT shall be billed separately as a RESIDENTIAL UNIT, when charges are due.
(C) Garbage definitions. For the purpose of this subchapter, the following definitions of the various kinds of garbage shall apply unless the context clearly indicates or requires a different meaning.
BULKY WASTE. Tree trimmings, dead trees or branches thereof, stoves, refrigerators, water tanks, washing machines, furniture, discarded mattresses, and other similar appliances and personal property.
CONSTRUCTION DEBRIS. Waste building materials resulting from construction, remodeling, repair, or demolition operations.
DEAD ANIMALS. Animals or portions thereof that have expired for any cause, except dogs and cats and animals slaughtered or killed for human use.
GARBAGE. Every accumulation of waste, (animal, vegetable, or other matter) that results from the preparation, processing, consumption, dealing with, handling, packing, canning, storage, transportation, decay, or decomposition of meats, fowl, fish, birds, fruits, grains, or other animal or vegetable matter, including, but not limited to, used tin cans and other food containers; and all putrescible or easily decomposable waste animal or vegetable matter which is likely to attract flies or rodents; except bulky waste, construction debris, or hazardous waste.
HAZARDOUS WASTE. Any chemical, compound, mixture, substance, or article which is prohibited from being taken for disposal at a sanitary landfill or which is designated by the EPA or appropriate agency of the state to be hazardous, as that term is defined by or pursuant to federal or state law.
JUNK. Copper, brass, iron, steel, rope, rags, batteries, tires, or other material other than wrecked vehicles that have been discarded or sold at a nominal price by the previous owner of the material.
REFUSE. Refers to garbage, rubbish, bulky waste, construction debris, and dead animals, generated by residential units, light commercial units, commercial units, and industrial units.
RUBBISH. All waste wood, wood products, grass cuttings, dead plants, weeds, leaves, chips, shavings, sawdust, printed matter, paper, pasteboard, rags, straw, used and discarded shoes and boots, combustible waste pulp, and other products such as are used for packing, or wrapping crockery and glass, ashes, cinders, floor sweepings, glass, mineral or metallic substances, and any and all other waste materials not included in the definitions of bulky waste, construction debris, dead animals, garbage, or hazardous waste.
