§ 152.39 PLAN APPLICABILITY.
   A storm water management plan approval issued under this subchapter runs with the land and is a condition of plat or development approval. Any landowner or subsequent landowner of any parcel within the plat or development area must comply with the plan or any approval, condition, revision or modification of the plan. The landowner must also comply with all applicable state subdivision registration, permit transfer/modification and notice of termination permits and provide a copy of the permit applications to the city for approval. Failure to comply with this plan shall constitute a violation and subject the permittee, developer and/or landowner to the enforcement provisions, penalties and non-compliance fees.
