(A) Granting. The Council may grant any application for the period of the remainder of the then current calendar year or for the entire ensuing license year. All applications, including proposed license periods, must be consistent with this business title.
(B) Issuing. If an application is granted, the Mayor and City Administrator shall forthwith issue a license pursuant thereto in the form adopted by resolution of the Council and upon payment of the license fee. All licenses shall be on a calendar year basis unless otherwise specified. All license fees shall be prorated on an annual basis based upon the date the application is submitted.
(C) Transfer. No license shall be transferable between persons or location. No license shall be transferable to a different location without prior consent of the Council and upon payment of the fee for a duplicate license. It is unlawful to make any transfer in violation of this section.
(D) Termination. Licenses shall terminate only by expiration or revocation.
(E) Refusal and revocation.
(1) The Council may, in its sole discretion and for any reasonable cause, refuse to grant any application or revoke any license. No license shall be granted to a person of questionable moral character or business reputation. In all cases of revocation, the Council shall give notice to the licensee of its refusal to grant any license or revoke any license.
(2) The applicant may request a hearing on the denial or revocation of any license by providing a written request for hearing within ten days of the date of notice to applicant. A written request for hearing delivered to the City Administrator’s office no later than ten days of the date of notice to applicant shall entitle applicant to a hearing on the license denial or revocation. The Council shall provide a hearing within 30 days of receiving a written request for hearing.
(F) Duplicate license. Duplicates of all original licenses may be issued by the City Administrator, without action by the Council.
