§ 34.02 DEPARTMENT OF PUBLIC SAFETY; CHIEF OF PUBLIC SAFETY.
   (A)   There is hereby created and established the Department of Public Safety.
   (B)   The Department of Public Safety shall perform all of the duties and responsibilities of the police and emergency management services of the city and shall have all of the powers, duties and responsibilities conferred upon the Police Department and emergency management services by virtue of the City Charter, code provisions and by law and shall have other and additional powers, duties and responsibilities as may be lawfully imposed upon it by any administrative directive, resolution, rule, code or Charter provision or law.
   (C)   The Department of Public Safety, under its Chief of Public Safety, shall be charged with the protection of all persons and property in the city, through the prevention of crimes, accidents and civil disorders, including activities designed to suppress criminal activities, control traffic, educate the public, manage emergencies and generally the enforcement of all code provisions and statutory laws applicable to the city. The Department shall be responsible for the coordination of public safety related functions of other city departments including, but not limited to, the Fire, Public Works and Engineering Departments.
   (D)   (1)   There is hereby created the administrative office of Chief of Public Safety who shall be the administrator and head of the Department of Public Safety. The Chief, who shall be a police officer licensed by the state, shall have all of the duties, responsibilities and functions conferred upon the Chief of Public Safety, and shall head emergency management services for the city. The Chief shall, in addition thereto, have the powers, duties and responsibilities as shall from time to time be lawfully conferred upon him or her by the Council and by law generally.
      (2)   Wherever any statute, code provision, city regulation or law shall require a duty or responsibility of the Chief of Public Safety and/or the performance of emergency management services, the duties and/or responsibilities shall be assumed and performed in the city by the Chief of Public Safety. The Chief of Public Safety shall be responsible for supervision of the city’s Director of Emergency Management and other emergency workers as deemed necessary for the public safety.
   (E)   The duties and responsibilities of the police officers shall be conferred upon them from time to time by the Chief of Public Safety; and, provided that, in addition thereto, the officers shall have and perform duties as are imposed upon police officers by the Council, the City Charter, code provisions and by law.
   (F)   The Council shall from time to time adopt rules and regulations as it may deem expedient for the proper administration of the Department of Public Safety and/or the duties, responsibilities and privileges of its officers; and, provided further that, the regulations shall become effective when posted on a bulletin board in the office of the Chief of Public Safety.
   (G)   The Chief of Public Safety shall be appointed by the Council for an indefinite period, may be removed by the Council at any time and shall be entitled to all appeal rights granted department heads under the city’s employee relationship policy adopted pursuant to § 31.55 of this code of ordinances.
