(a) Permit Required. No person shall kindle or maintain any fire or authorize any such fire to be kindled or maintained, which fire or burning is otherwise permitted by Federal and State Statutes or Rules and Regulations, without a permit or other authorization from the Fire Chief.
(b) Restrictions on Burning. No person shall burn anything permitted to be burned by Federal and State Statutes or Rules and Regulations upon any street, sidewalk or other public place in the Town or upon any private property, where such burning creates any obnoxious odors or endangers other properties.
(c) Location Restricted. No person shall kindle or maintain any fire permitted by Federal and State Statutes or Rules and Regulations or authorize any such fire to be kindled or maintained on any private land unless:
(1) The location is not less than fifty feet from any structure and adequate provision is made to prevent fire from spreading to within fifty feet of any structure, or
(2) The fire is contained in a waste burner of a type approved by the Fire Chief and which is located safely not less than fifteen feet from any structure.
(d) Attendance of Open Fires. Fires permitted by Federal and State Statutes or Rules and Regulations shall be constantly attended by a competent person until such fire is extinguished. This person shall have a garden hose connected to the water supply or other fire extinguishing equipment readily available for use.
(e) Chief May Prohibit. The Fire Chief may prohibit any or all fires which are permitted by Federal and State Statutes or Rules and Regulations when atmospheric conditions or local circumstances make such fires hazardous.
