(a) At least ten days before an election to fill any Town office at which the voters of the Town are entitled to vote, the Recorder shall cause to be published a list of candidates for office certified by them and filed in their office, such nominations to be published as Class II-0 legal advertisement in compliance with the provisions of West Virginia Code 59-3-2, and the publication area for such publication shall be the Town. The second publication shall be on the last day upon which each newspaper is published before the election. Whenever it appears by affidavit that an error or omission has occurred in the publication of the names or description of candidates for Town office, or in the printing of the ballots, the Ballot Commissioner shall correct such error. The list of candidates so published shall be arranged in the order and form in which they will be printed upon the ballot.
(b) At least ten days prior to any election in the Town at which any questions is to be submitted to the voters, the Ballot Commissioner shall cause to be published, in the same manner provided in subsection (a) hereof, a statement of the question which is to be voted on and the effect of a “yes” or “no” (or a “for” or “against”) vote, together with a sample of the ballot to be used for such purposes, if such ballots have then been printed.
