105.07 CERTIFICATE OF CANDIDACY; FILING FEES.
   (a)   Any person who is eligible to hold a municipal office, either as Mayor, Recorder or Councilperson, may file with the Recorder a certificate declaring him/herself a candidate for such office, which certificate shall be in form and effect as follows:

of the Town of Fayetteville, West Virginia, and desire my name printed on the ballot to be voted at the municipal election to be held on the                 day of                       , 20      ; and that I am a legally qualified resident of the Town of Fayetteville, and I am a legal voter entitled to vote in said Town; that I am eligible to hold said office; that I am a candidate for said office in good faith.

   (b)   Such certificate shall be signed and acknowledged by the candidate before some officer to administer oaths, who shall certify the same.

   (c)    Such certificate shall be filed with the Recorder not earlier than the second Monday in January before the Town's election day and not later than the last Saturday in January before the Town's election day and must be received before midnight, eastern standard time, of that day or, if mailed, shall be post marked by the United States Postal Service before that hour.
 
   (d)   Every person who becomes a candidate for office in any Town election, shall, at the time of filing the certificate of candidacy as required above, pay a filing fee to the Recorder in the amount of one percent (1%) of the annual salary of the office for which the certificate of candidacy is filed.

   (e)   All money received by the Recorder from such fees shall be credited to the general revenue of the Town.
