755.19 CONTRACTORS.
   (a)    "Building contractor" means any person, corporation or business enterprise engaged in the building and construction business as a general contractor and also includes all specialized phases thereof, including, but not limited to, services in connection with site preparation and excavation, landscaping, roofing and siding, plumbing and electrical, heating and air conditioning, glass and fencing, and all services involved in the repair and improvement of real estate, homes, buildings and other structures.
   (b)    By virtue of this section, no person, corporation or business enterprise may engage in the business of building or construction, as the same is hereinafter defined, unless first duly licensed so to do by the Town; provided, however, that this requirement shall not apply to any person, corporation or business enterprise which in the aggregate engages in such building or construction work at a cost of less than one thousand dollars ($1,000) per year.
   (c)    The license required by this section shall be referred to as a “contractor's license” and shall be obtained at the office of the Town Manager upon submission of form to be provided by the Town and executed by the applicant for license. The license period shall be the fiscal year from July 1 to June 30 and the fee shall be seventy-five dollars ($75.00) per year. Any license obtained after the start of the fiscal year shall not be prorated as to the license fee.
   (d)    Employees of a building contractor shall not be required to be individually licensed but subcontractors and independent operators engaged on the same project as the principal contractor shall be required to have such a license.
   (e)    No license may be issued to any building contractor who has not paid in full all business and occupation taxes, all license taxes fees, and any other tax or fee due the Town, and submitted proper returns therefor. If in the opinion of the Town Manager the applicant for a contractor's license is not a bona fide building contractor, as defined herein, or if there is good reason to deny the same, the Town Manager, in the exercise of his judgment and discretion, shall not issue such license, and the applicant shall have the right to appeal the Town Manager's decision to the Town Council.
   (f)   Violation of this section shall constitute a misdemeanor and subject the violator to a fine of five hundred dollars ($500.00), plus one hundred dollars ($100.00) for each day the violation occurs.
