133.06 PLANNING COMMISSION MEETINGS; QUORUM; OPEN MEETINGS REQUIREMENTS.
   (a)   Regular Meetings. Pursuant to W. Va. Code §8A-2-7, the Planning Commission shall meet a least quarterly and may meet more frequently at the request of the President or by two (2) or more members. The Planning Commission shall make its own rules of procedure and determine the time of the meeting.
   (b)   Special Meetings. Notice for a special meeting must be in writing, include the date, time, place, and purpose of the special meeting. Notice for a special meeting must be posted and sent to all members at least two (2) business days before the special meeting.
   (c)   Quorum. Pursuant to W. Va. Code §8A-2-8 the Planning Commission must have a quorum to conduct a meeting. A simple majority of the Planning Commission members present (minimum of five (5)) constitute a quorum. No action of the Planning Commission is official unless authorized by a majority of the members present at a regular or properly called special meeting.
   (d)   Open Meetings and Public Record. All Planning Commission meetings shall be open to the public unless discussing matters that are permitted under W. Va. Code §6-9A-4 as an exception to the State's open governmental proceeding act. The Planning Commission shall follow all rules and regulations pertaining to notice, setting the agenda, and taking minutes for each meeting. (Passed 12-1-22.)
