(a) There is hereby formed, created and established a municipal building commission to be known as the Fayetteville Building Commission (the Commission). In accordance with West Virginia Code Article 8-33 the Commission shall be a public corporation and have perpetual existence.
(b) The Commission shall have all powers granted by West Virginia Code Article 8-33 and any other powers granted to it by applicable law.
(c) The Board of the Commission shall consist of 3 members.
(d) At the conclusion of the term of the appointment of each member of the Commission, the Town Council of the Town of Fayetteville shall appoint a successor for a term of 5 years. Not more than 2 of the 3 members of the Board named above are from the same political party, and no member named above holds any office (other than the office notary public) or employment under the United States of America, the State of West Virginia, any county or political subdivision thereof, or any political party. All members named above are residents of the Town of Fayetteville.
(e) The Commission shall not incur any indebtedness or acquire any property, real or personal, without the prior written consent of the Town Council of the Town of Fayetteville.
(f) No indebtedness of any nature of the Commission shall constitute an indebtedness of the Town of Fayetteville, the County of Fayette, or any agency thereof, except the Commission. No indebtedness or obligations incurred by the Commission shall give any right against any member of the Town Council of the Town of Fayetteville or any member of the Commission.

(g) No member shall serve more than two consecutive terms.
(Note: No member of Council should be on this Commission, since no elected official can serve).
