No gain or profit shall be derived by the Town, the Fayetteville Cemetery Commission, or the trustees, or by any individual or corporation charged with any of the duties or responsibilities hereunder, and any person or corporation who shall directly or indirectly receive any such gain or profit from any transaction or activity hereunder shall refund the same upon demand of Council, and shall be guilty of a violation of this article. Any misfeasance in office shall likewise be a violation of this article.
