202.03 SALE OF TOWN PROPERTY BY SEALED BIDS.
   (a)   The Town may sell any of its real or personal property, or any interest therein or part thereof for a fair and adequate consideration, by accepting sealed bids for the property, but before making any sale, notice of the time, terms, and place of sale, together with a brief description of the property to be sold, shall be published as a Class II legal advertisement in compliance with the provisions of West Virginia Code Chapter 59, Article 3, Section 1, et seq., and the publication area for the publication shall be the Town and any other area that Council deems appropriate.
   (b)   In seeking bids for the sale of real property owned by the Town, the Town may require submission of plans for the development of the property and may restrict the use of the property being sold and require specific development of the property to facilitate economic development projects and/or to provide a necessary and convenient resource for the benefit of the residents of the Town.
   (c)   In considering the bids submitted, the Council may consider: the price to be paid for the property to be sold, the project submitted, the experience, expertise, and prior success on similar projects exhibited by the bidder.
