WHEREAS, the Town of Fayetteville seeks to enhance the overall quality of life of its
citizens, and
WHEREAS, the Town of Fayetteville, believes that it can improve the economy, infrastructure and social well-being of its community if permitted to adopt the Home Rule Program as provided by West Virginia Code§ 8-1-5a(b) and§ 8-1-5a (c)(1), and
WHEREAS, the Town of Fayetteville is a Class III municipality under State law and is eligible to participate in the Municipal Home Rule Program, and
WHEREAS, the Town Council finds that participating in the Municipal Home Rule
Program is in the public interest, and
WHEREAS, the Town of Fayetteville's inclusion in the Municipal Home Rule Program
would permit more efficiency and enable it to more effectively and responsibly pursue and successfully achieve the aforesaid goals.
NOW, THEREFORE, BE IT ORDAINED BY THE FAYETTEVILE TOWN COUNCIL:
Upon its passage, this Ordinance shall be titled and officially known as the "Fayetteville Home Rule Authorization Ordinance".
The Mayor, Town Recorder, and Town Manager are hereby authorized and directed to complete and submit consistent with the form of Home Rule Plan attached hereto and as provided by West Virginia Code § 8-1-5a, a formal Application and a proposed Home Rule Plan to the Municipal Home Rule Board for its consideration and approval.
This Ordinance shall become effective immediately upon its second reading and passage.
