The Chief of Police shall notify, in writing, the owner, occupant or person in charge of any premises to cut any weeds or grass that exceeds twelve (12) inches in height. Such notice shall be sent to the last known address of the owner, occupant or person in charge of any premises. If the notice is refused or returned, the Town shall attempt to serve the notice on the owner of said property as disclosed by the records maintained in the Office of the Assessor or Sheriff of the County in accordance with Rule 4 of the West Virginia Rules of Civil Procedure.
