133.02 COMPOSITION AND ORGANIZATION; QUALIFICATIONS; APPOINTMENT AND TERMS OF MEMBERS; FILLING VACANCIES.
   (a)   Composition. Planning Commission members shall be appointed and confirmed by the Town Council. The Planning Commission shall consist of eight (8) members. One member must be a member of the Town Council or its designee, and one member must be a member of the administrative office of the Mayor or the Mayor's designee. The terms of membership for those two (2) members are the same as their terms of office and neither shall serve more than two (2) consecutive terms. Of the six (6) remaining members of the Planning Commission, the positions must be filled to fairly represent different areas of interest, knowledge, and expertise, including, but not limited to business, industry, labor, government, and other relevant disciplines. All appointees to the Planning Commission shall be residents of the Town, and at least three-fifths (3/5) of those appointed shall have been residents of Fayetteville for a period of at least three (3) years prior to confirmation.
   (b)   Terms of Service. The terms of the six (6) remaining appointees shall be staggered Three year terms.
   (c)   Removal. The Town Council may establish procedures for the removal of members of the Planning Commission for inactivity, neglect of duty, or malfeasance. The procedures must contain provisions requiring that the person to be removed be provided with a written statement of the reasons for removal and an opportunity to be heard on the matter.
   (d)   Filling Vacancies. Should a vacancy arise on the Planning Commission for any reason during the duration of a term, the vacancy shall be filled for the unexpired term in the same manner as provided hereinabove.
   (e)   Officers. At the first meeting each year the members of the Commission shall elect from among its members a President and Vice President.
      (1)   The President shall preside over all meetings of the Planning Commission and over all public hearings and public meetings called by the Planning Commission. The President shall transmit reports, plans, recommendations, and other documents from the Planning Commission to all appropriate authorities or bodies. The President shall act as spokesperson for the Planning Commission.
      (2)   In the President's absence, the Vice-President shall have the power and authority to act as President of the Planning Commission. The Vice-President shall perform additional duties and functions as may be required by the Planning Commission.
      (3)   In the absence of both the President and Vice-President and, as long as there is a quorum, the members present shall elect a President pro tempore, who shall only act as President for the durtion of the meeting.
