3.04.020: DEFINITIONS:
As used in this chapter:
   BID LIMIT: Means:
   A.   For a building improvement:
1. For the year 2003, forty thousand dollars ($40,000.00); and
2. For each year after 2003, the amount of the bid limit for the previous year, plus an amount calculated by multiplying the amount of the bid limit for the previous year by the lesser of three percent (3%) or the actual percent change in the Consumer Price Index during the previous calendar year; and
   B.   For a public works project:
      1.   For the year 2003, one hundred twenty five thousand dollars ($125,000.00); and
      2.   For each year after 2003, the amount of the bid limit for the previous year, plus an amount calculated by multiplying the amount of the bid limit for the previous year by the lesser of three percent (3%) or the actual percent change in the Consumer Price Index during the previous calendar year.
   BUILDING IMPROVEMENT: The construction or repair of a public building or structure.
   BUSINESS: Any corporation, partnership, individual, sole proprietorship, joint stock company, joint venture, or any other private legal entity.
   CHANGE ORDER: A written order signed by the Procurement Officer, directing the contractor to suspend work or make changes, which the appropriate clauses of the contract authorize the Procurement Officer to order without the consent of the contractor or any written alteration in specifications, delivery point, rate of delivery, period of performance, price, quantity or other provisions of any contract accomplished by mutual action of the parties to the contract.
   CONTRACT: Any City agreement for the procurement or disposal of supplies, services or other items not related to new improvements as used in Utah Code Annotated title 63G, chapter 6a, or to the construction or improvement of any Class C road.
   EMERGENCY REPAIRS: A building improvement or public works project undertaken on an expedited basis to:
   A.   Eliminate an imminent risk of damage to or loss of public or private property;
   B.   Remedy a condition that poses an immediate physical danger; or
   C.   Reduce a substantial, imminent risk of interruption of an essential public service.
   INVITATION FOR BIDS: All documents, whether attached or incorporated by reference, used for soliciting bids.
   PERSON: Any business, individual, union, committee, club, other organization, or group of individuals.
   PROCUREMENT: Buying, purchasing, renting, leasing, leasing with an option to purchase, or otherwise acquiring any supplies or services.
   PROCUREMENT OFFICER: The person duly authorized by the Governing Body of the City to enter into and administer contracts and make written determinations with respect thereto.
   PUBLIC WORKS PROJECT:
   A.   Means the construction of a park or recreational facility or a pipeline, culvert, dam, canal, or other system for water, sewage, stormwater, or flood control; and
   B.   Does not include the replacement or repair of existing infrastructure on private property.
   PURCHASE DESCRIPTION: The words used in a solicitation to describe the supplies or services to be purchased, and includes specifications attached to or made a part of the solicitation.
   REQUEST FOR BIDS: All documents, whether attached or incorporated by reference, used for soliciting proposals.
