2.30.040: DISPOSAL OR SALE OF REAL PROPERTY:
   A.   If the City Council determines that a significant parcel of real property has become surplus or excess, the City Council may then authorize the sale of such parcel by any method deemed appropriate by the City Council on terms and conditions deemed to be in the best interests of the City and in accordance with this chapter.
   B.   Before any sale or disposition of a significant parcel of real property, the City shall provide an opportunity for public comment on the proposed sale or disposition and provide notice of the opportunity for public comment at least fourteen (14) days prior to the meeting.
   C.   If, after public comment has been received, the City Council makes a determination to proceed with the sale or disposition, the property may be sold by any method deemed appropriate by the City Council on terms and conditions deemed to be in the best interests of the City and in accordance with this chapter.
   D.   All real property deemed to be surplus may be traded for other real property or in-kind consideration only if the property received is of equivalent value as determined by a professional certified appraiser unless there is an express authorization by the City Council for trading for property of a lesser value.
   E.   A parcel of property which is deemed surplus or excess by the City Council but is not a significant parcel of real property, may be disposed of by any method deemed appropriate by the City Council on terms and conditions deemed to be in the best interests of the City and in accordance with this chapter.
   F.   Any real property deemed to be surplus shall not be sold for less than fair market value unless specifically approved by the City Council. (Ord. 13-08)
