15.04.020: ADDITIONAL REQUIREMENTS:
In addition to the above codes and standards, the following requirements shall also be met:
   A.   The dwelling must be permanently connected and attached to a site built permanent foundation which meets ICBO guidelines, for manufactured housing installations if a manufactured home. Any running gear shall be removed and stored out of sight. Any enclosure must be secured to the perimeter of the dwelling and constructed of materials that are weather resistant and aesthetically consistent with the concrete and masonry foundation materials.
   B.   The dwelling must be permanently connected to and approved for all required utilities.
   C.   The dwelling must be taxed as real property. If the dwelling is a manufactured home, an affidavit must be filed with the State Tax Commission pursuant to the Utah Code Annotated 59-2-602 and qualified therefor as an improvement to real estate.
   D.   The dwelling must provide a minimum of seventy two (72) square feet of enclosed storage in a basement or garage area or in an accessory storage structure with a minimum height of six feet (6'). Such structure shall conform to all applicable Building Codes.
   E.   Porches and landscaping for ingress and egress to the dwelling must be built in accordance with chapter 33 of the Uniform Building Codes as adopted by the State of Utah.
   F.   At least sixty percent (60%) of the roof must be pitched as a minimum three to twelve (3:12) pitch and shall have a roof surface of wood shakes, asphalt, composition, wood shingles, concrete, metal tiles, slate, built up gravel materials or other materials approved by the Uniform Building Code.
   G.   The dwelling shall have exterior siding consisting of wood, masonry, concrete, stucco, masonite or metal vinyl lap. The roof overhang, including rain gutters, shall not be less than one foot (1'), measured from the vertical side of the building but not including bay windows, nooks, morning rooms, etc.
   H.   The width of the dwelling shall be at least twenty feet (20') at the narrowest point of its first story for a depth of at least twenty feet (20') exclusive of any garage area. The width shall be considered the lessor of the two (2) primary dimensions. Refer to Farr West City zoning ordinance for area and minimum height and square footage.
   I.   Required off street parking spaces shall be side by side.
   J.   The building inspector, in concert with the Planning Commission, may approve deviations from one or more of the development or architectural standards provided herein on the basis of a finding that the architectural style proposed provides compensating design features and that the proposed dwelling will be compatible and harmonious with existing structures in the vicinity.
   K.   All new home building permit applications shall have a restriction that the lowest finished floor elevation in the dwelling shall not be lower than the adjacent top back of curb elevation or if curb is not present, no lower than the existing ground surface. Finished floor is defined as any basement or story of a dwelling that is or can be made to be living space, as that term is defined in the current edition of the International Residential Code. Exceptions:
      1.   New dwellings proposed to have the lowest finished floor elevation below the adjacent top back of curb elevation will be allowed provided that the dwelling units have a City-approved subsurface drainage system consisting of a subsurface ground water collection system as part of the dwelling construction, a sump pump station and discharge piping to an authorized or approved discharge location. The maximum finished floor depth in these dwellings shall not be greater than thirty inches (30") below the adjacent top back of curb elevation.
      2.   If a geotechnical study conducted by a licensed, professional engineer is provided for any lot or group of lots that shows the existing ground water level is greater than 8.0 feet below ground surface (bgs), then that lot or lots shall not be designated as "restricted" and full basements shall be permitted, provided that the lowest finished floor is not deeper than six (6.0) feet bgs.
Sump pumps, whether required by subsection K1 of this section or installed voluntarily, shall not be connected to the sanitary sewer system in any manner. The City will not issue building permits for dwellings until any proposed subsurface drainage system design has been reviewed and approved by the City building official. Final occupancy shall not be granted to any new home owner until any previously approved subsurface drainage collection system, sump pump and discharge line connections have been inspected and completed and are operational. The ownership, operation and maintenance of the entire subsurface drainage system shall be the total responsibility of the individual property owner. (Ord. 2017-11: Ord. 17-05: Ord. 99-03)
