9.08.100: PENALTY:
   A.   A person convicted of a first time violation of this chapter shall be guilty of an infraction.
   B.   A person who has previously been convicted of a violation of this chapter shall be guilty of a class C misdemeanor. (Ord. 01-04 § 1)
