§ 153.01 POLE AND WIRE PLACEMENT.
   (A)   (1)   The Town Council, by its Street Commissioner or proper municipal officer, exercises exclusive control over any and all telegraph, telephone, electric and steam railroad companies holding a right of franchise, or that may hereafter be granted a right of franchise, within the corporate limits of the town compelling them or any of them to remove any and all poles now set, or that may hereafter be set, to any place designated on any street or alley in said town that will be more convenient or assure greater safety to the general public, and to raise any and all wires now strung or that may hereafter be strung so as to clear the ground at least 25 feet.
      (2)   All telegraph, telephone, electric light and all other wires of any kind hereafter constructed within the corporate limits of said town shall be supported by good, substantial wooden poles of a size not less than 12 inches in diameter at the bottom and not less than six inches in diameter at the top or iron or steel poles not less than five inches in diameter at the bottom and three inches in diameter at the top. Such poles are to be set in the earth to a depth of not less than six feet and well tamped; all such wires shall clear the ground at least 25 feet and shall be fastened to said poles in such manner as will properly hold the wires in place.
   (B)   It shall be the duty of the Street Commissioner or proper municipal officer of the town to see that the provisions of this section are enforced, and such municipal officer shall have the power within the corporate limits of said town to require telegraph, telephone, electric light and other wires constructed along and over the streets and alleys of the town to conform to the provisions of this section.
   (C)   Note that the town does not currently own any poles within the town limits. The respective utility departments, companies or franchises own the poles and are responsible for maintaining them. When maintenance, repair, replacement, removal or any other work is to be performed on poles within the town limits, respective utility departments, companies or franchises shall contact the town. Each utility has its own standards and codes, which shall prevail over divisions (A) and (B) above. All provisions of the most current version of the National Utility Codes and Standards shall apply to the utilities owning poles within the town; where the National Utility Codes and Standards or private policies of a utility department, company or franchise do not provide adequate provisions, divisions (A) and (B) above shall apply.
