(A) The police reserve(s) shall function under the Town Marshal, or in his or her absence, the senior officer on duty, pursuant to the requirements of all applicable state law and other applicable law, including, but not limited to, the provisions of I.C. 36-1-3 et seq. and also I.C. 36-8-3-20. Before becoming a police reserve, each member shall take an oath provided by the statutes of the state, or pursuant to law, and shall be issued a card signed by the Town Marshal, which card shall be retained in the possession of the police reserve at all times.
(B) Police reserves shall have all powers and authority, and shall be subject to all duties, of regular police officers, except as allowed by law and as limited by the rules of their Department, and provided, however, that membership in the Police Reserves shall not constitute membership in the regular Police Department of the town, nor shall any member of the Police Reserves be entitled to any rights or privileges of compensation, pension or other rights or privileges of members of the regular Police Department. Additionally, police reserves shall not be entitled to any monetary compensation, shall not be entitled to receive compensation for time lost from other employment because of court appearances, shall not be insured for life, accident or sickness coverage, and further, shall not be eligible to participate in any pension program provided for regular members of the Department.
(C) The Town Marshal, with the approval of the Town Council, is hereby authorized to formulate and adopt written rules to govern the authority, operating procedure, duties and functions of the Police Reserves.
