(A) Public policy declared. It is declared to be in the best interest of the public policy and the public safety of the town to regulate and restrict the parking of vehicles on public streets during snow emergencies.
(B) Snow emergency defined. For the purpose of this schedule, the following definition shall apply unless the context clearly indicates or requires a different meaning.
SNOW EMERGENCY. A period of time after a forecast by the United States Weather Bureau during and after a snowfall during which vehicular traffic is expected to be particularly hazardous or congested due to the elements, and during which period of time the parking of vehicles could hinder, delay and obstruct the safe flow of traffic and the proper cleaning, clearing and making safe of certain heavily traveled public streets of this town.
(C) Snow control routes designated. Which streets shall be designated snow control routes are as follows, to wit:
(1) New York Street;
(2) East and West Williams Street;
(3) North and South Mulberry Street;
(4) North and South Plum Street; and
(5) East and West Henry Street.
(D) Town Council to declare snow emergency.
(1) A snow emergency shall commence by executive order, determination and or proclamation by the Town Council or other designated town official, such as the Town Marshal, or if declared by the county, as issued to local radio, television and news services either before, during or after a snowfall, when in the Council’s sound judgment and discretion, the circumstances warrant the determination of such an emergency for the public safety of the town.
(2) The snow emergency shall continue in effect until the Council determines that an emergency no longer exists and accordingly terminates the emergency using the same media as before.
(E) Penalty. It is hereby declared that any vehicle not moved during such a designated snow emergency shall be towed to the town-owned property or to a private garage, where the vehicle may be impounded and shall be released only at the owner’s expense.
