Any person, governmental entity or provider desiring to construct, maintain, repair, operate or use any improvements or facilities to be located within the public right of way shall be required to obtain a franchise or other acceptable rights of way use agreement or license agreement with the city authorizing the use of the public right of way for such improvements or facilities in accordance with the provisions of section 8-2-030.1 of this title, as amended, in addition and prior to the issuance of any excavation permit for work within the public right of way.
