7-3-060: CONTAINERS:
   A.   Approved Containers: All garbage to be collected by the city from each residential user shall be placed only in approved garbage containers issued to such residential user and use of containers issued to other users for garbage disposition is prohibited. All other garbage not collected by the city shall be placed in suitable and sanitary garbage receptacles.
   B.   Title To Containers: Title to the approved garbage containers furnished by the city to residential users shall be retained by the city.
   C.   Care And Maintenance: All persons using approved garbage containers furnished by the city shall keep such container(s) free from destructive or decorative markings, shall maintain the original color thereof, shall keep the inside of said containers clean and free from build up of fungus or bacteria or any other type of contaminant that causes odors or facilitates deterioration of the inside or outside of such container, and shall not deposit any hot or caustic materials therein or otherwise damage, deface or abuse such containers. Any damage to containers caused by the residential user's use or abuse of such container shall be the responsibility of the user and paid upon demand to the city.
   D.   Report Of Damage Or Malfunction: Residential users shall promptly report to the city, or its authorized contractor, any damage to or malfunctioning of the approved garbage containers that limit their usefulness for receipt of garbage so that the same may be repaired or replaced.
   E.   Loss; Deposit Required: Residential users shall exercise due care to protect containers against loss through theft or misappropriation or from other causes. Loss of approved containers is the responsibility of the resident. In case of loss, a fifty dollar ($50.00) deposit shall be paid prior to the city issuing a replacement container. If the lost container is later recovered and is in usable condition, the deposit may be refunded. The deposit requirement may be waived at the discretion of the city manager upon a showing of good cause.
   F.   Nontransferable: Approved garbage containers furnished by the city are issued to specific residential addresses by number and are not nontransferable. Upon discontinuance of use by a resident, their approved garbage container(s) shall remain at the property unless the city requests the container be delivered to the city public works facility.
   G.   Overfilling; Rainproof, Flyproof: Approved garbage containers shall not be overfilled to the extent that the contents may be spilled during the process of pick up and dumping into the garbage collection vehicle. All commercial solid waste shall be placed in rainproof and flyproof receptacles and the receptacles shall be tightly closed in such a manner as to prevent offensive odors or flies and unsightly conditions.    H.   Temporary Discontinuance: Any resident who desires to temporarily discontinue garbage collection service may request the city pick up the approved garbage container issued to that residence. Such a request for temporary discontinuance shall be made in writing, stating the residence address, the name of the person making the request, the estimated period of discontinuance, which shall be not less than sixty (60) days, and shall be accompanied by the required administrative fee as set forth in the city's consolidated fee schedule.
