A. Unless otherwise provided, it shall be unlawful for any person to engage in any business within the city without first having obtained a business license pursuant to this title or to continue doing business after a previously issued business license has expired without renewing said license and paying any applicable fees and penalties.
B. Mobile businesses are subject to this requirement to obtain a business license, except as provided in this chapter. A separate license shall be required for each vehicle, trailer, cart, or mobile structure. Each day of noncompliance shall constitute a separate violation.
1. Exception: A business which meets the definition of a mobile business such as a food truck under Utah law is not required to obtain a Farmington City license if it has previously received the necessary health and fire inspections and is licensed with another jurisdiction within the State of Utah in accordance with Chapter 11-56 of the Utah State Code.
2. Unless operating at a private event, all mobile businesses must operate in zones where the business activity is permitted and with permission of the property owner or representative. Unless approved as part of special event permit by Farmington City, mobile businesses shall not operate in the public right of way or on Farmington City property.
C. Low-impact Home Occupations: A home occupation business whose combined offsite impact of the home-based business and the primary residential unit does not exceed the offsite impact of the primary residential unit alone is not required to obtain a business license in accordance with Utah State Code 10-1-203 (7) but may voluntarily obtain one.
D. Businesses operated only occasionally and by an individual who is under eighteen years old are not required to obtain a business license. (Ord. 2014-38, 12-2-2014; amd. Ord. 2023-22, 4-4-2023)
