For purposes of determining eligibility under the Utah retirement system and provisions of the Utah state retirement and insurance benefit act, as set forth in Utah Code Annotated title 49, the city hereby certifies that any appointive officer position requiring less than forty (40) hours of work per week shall be considered a part time appointive officer position. Unless otherwise provided by law, any appointive officer appointed for the first time to a part time appointive officer position on or after July 1, 2011, shall not be eligible for participation in the Utah retirement system.
