§ 114.02 FACTORS TO BE CONSIDERED.
   In making his recommendation to the Mayor, the Chief of Police, or his designee, shall take into account the following circumstances:
   (A)   The place of such temporary sale or display shall not interfere unreasonably with the flow of traffic within the city limits.
   (B)   The licensee must demonstrate permission from the owner or lessee of the premises on which the temporary sale or display is to be conducted.
   (C)   The duration of such sale must be reasonable, and not interfere with the flow of traffic within the city.
   (D)   The times of operation of such sale or display shall be reasonable and shall not interfere with the conduct of other businesses, traffic or other events which may be taking place on or near the same location at the same time.
   (E)   The premises shall be large enough so customers can freely circulate among the motor vehicles displayed for sale or display, so that the rights of way of the city, to include streets, sidewalks, and other rights of way, do not become congested due to the press of people.
   (F)   The Chief of Police, or his designee, shall ascertain whether or not additional police protection is required for such sale or display, and if so, whether the Police Department can effectively and officially render the additional police protection.
   (G)   If such sales or displays are to take place after the hours or darkness, the site must have provisions for lighting so as to protect the public safety.
